Welcome to Cape Town Web Hosting! We strive to provide an affordable and quality service to all of our clients. Please read these terms and conditions carefully before ordering any of our services. By placing an order with Cape Town Web Hosting, you agree to these terms and conditions.

Suspension and Legal Proceedings Cape Town Web Hosting reserves the right to suspend an account if these terms are breached. We also reserve the right to institute legal proceedings in respect of any damages incurred by any breach of these conditions.

Order Processing We will process an order within 48 hours after payment has been received, but accept no responsibility if a domain name is no longer available. Once an order for domain registration has been placed, it cannot be canceled unless an email is received at support@capetown-web-hosting.co.za prior to the order being processed.

Refusal of Service Cape Town Web Hosting reserves the right to refuse service and/or access to its servers to anyone at any time.

Illegal or Fraudulent Activity Clients who use our servers for any illegal or fraudulent activity or to send out “junk mail”, “SPAM”, “chain letters”, “viruses”, “worms”, “Trojans”, “phishing” messages, or unsolicited mass distribution of e-mail will have their account(s) suspended and their payments will be forfeited.

Content Restrictions We do not allow the following content to be stored on or transmitted from our servers:

  • Illegal Material – This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any South African Electronic Law regulation.
  • Adult Material – Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of “adult material” is left entirely to the discretion of Cape Town Web Hosting.

Bandwidth Policy Cape Town Web Hosting may implement the following policy regarding bandwidth to its sole discretion: When a website is found to be monopolizing the resources available, the account holder will be contacted to discuss the situation. If no arrangement can be reached, Cape Town Web Hosting reserves the right to terminate the account giving one day’s notice.

Backup Responsibility The client is responsible for keeping a backup copy of all material held on the website. Annual renewal notices will be sent at least 30 days prior to renewal. Payments must be received prior to the domain name renewal date to continue service.

Confidentiality Cape Town Web Hosting will provide confidentiality and will not forward any information provided by clients.

Indemnification The customer agrees to defend, indemnify, save and hold Cape Town Web Hosting harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against Cape Town Web Hosting, its agents, its customers, officers, and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by the customer, its agents, employees or assigns. The customer agrees to defend, indemnify and hold harmless Cape Town Web Hosting against liabilities arising out of; any injury to person or property caused by any products sold or otherwise distributed in connection with Cape Town Web Hosting’s servers; any material supplied by the customer infringing or allegedly infringing on the proprietary rights of a third party; copyright infringement and any defective products sold to the customer from Cape Town Web Hosting’s servers.

Disclaimer Cape Town Web Hosting will not be responsible for any damages your business may suffer. We make no warranties of any kind, expressed or implied for services we provide. We disclaim any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Cape Town Web Hosting and its employees/servants.

Policy

Governing Law and Jurisdiction

The agreement between Cape Town Web Hosting and the client will be governed by and construed in accordance with the laws of the Republic of South Africa. The client consents to the exclusive jurisdiction of the High Court of South Africa, Western Cape Division, Cape Town, in respect of any disputes arising from this agreement.

Intellectual Property

The client agrees that they will not use any intellectual property rights of Cape Town Web Hosting without prior written consent. Intellectual property rights include but are not limited to trademarks, logos, designs, patents, and copyrights.

Termination of Service

Cape Town Web Hosting reserves the right to terminate any service agreement at any time. In the event of termination, the client will be responsible for all fees incurred up to and including the date of termination.

Refund Policy

Cape Town Web Hosting offers a 30-day money-back guarantee on all hosting packages. If the client is not satisfied with the service within 30 days of the initial order, they may request a refund. No refunds will be issued after the initial 30-day period.

Limitation of Liability

Cape Town Web Hosting will not be liable for any damages, including but not limited to, direct or indirect damages, incidental damages, punitive damages, or consequential damages, arising from the use or inability to use any of the services provided by Cape Town Web Hosting.

The maximum liability of Cape Town Web Hosting to the client for any reason whatsoever shall be limited to the amount paid by the client for the services provided.

Entire Agreement

These terms and conditions constitute the entire agreement between Cape Town Web Hosting and the client and supersede all prior agreements and understandings, whether written or oral, relating to the subject matter of this agreement.

By placing an order with Cape Town Web Hosting, the client acknowledges that they have read and understood these terms and conditions and agree to be bound by them.
